Bogus Firearms Prosecution

Chilling government response to what everyone held to be a jammed rifle on a range. It's interesting to see how the response to this gentleman's situation was handled. The Justice system seems to be focused on the WRONG THING.

The problem is NOT a man who has a malfunctioning rifle on a range. It's with gang members and criminals who commit crimes. If you're at all interested, please take time to view this video.

This makes no sense. What do the ladies and gentlemen of the jury say their logic was?

On a related topic, Con Scalawag has a funny video up. AR versus AK.

I agree with Opus, this makes no sense whatsoever. If this were a gang member, what a slap on the wrist? Probation? A complete miscarriage of justice in my opinion.

This is completely bogus and scary at the same time. Who's the DA pressing this case? Liberalism has no bounds in what it will do to destroy the foundational principles of the US.

Cool sunglasses by the way...

Not a District Attorney - an Assistant United States Attorney (federal district court for this one). I'm sure the jury instructions left the jury cowed. "If the weapon fired more than one round with the pull of a trigger, you must find that the man is guilty, irrespective of whether the weapon malfunctioned or not."

It's how juries are bent to the government's will. I know how these things are done because I was with the Orange County (CA) District Attorney for twenty-one years before I retired two years ago -- to become an international jewel thief.

And I'm sure they had to shop around for an AUSA to prosecute this case. I've seen cases done by BATF that are even more obtuse and strange than that one. I personally washed my hands of that sort of thing and encouraged the government NOT to prosecute, but that's another story.

DA's and AUSA's should be prosecutors, not persecutors.

Now they also want to ban knives. Obama must be getting really nervous.

Wo-Fat, when they decide to ban rocks, we have even bigger problems. David slew Goliath with a rock and a strip of leather.

Maybe leather will be a thing of the past. If so, many people will find their love life has also been banned. (I speak of "Bambi's friend")

[inside joke between WoFat and me]

You're absolutely right about the persecution/prosecution. The surprising thing is that justice gets meted out at all. I was in LA when the riots broke out over the acquittal of the police who beat Rodney King. So the feds stepped in and found them guilty of hate crimes (not technically double jeopardy).

I also had a friend who had adopted a little boy who happened to not be the same color as she was. She accidentally scalded him in the tub and rushed him to the emergency room. CPS heard about the incident and attacked her as a racial bigot and sent her to jail.

This kind of garbage needs to get more press.

Goliath was a right wing rock owner. He deserved what he got.

This is a frieghting case. That your weapon could malfunction, and then be prosecuted for having a full auto. Insanity, and a miscarage of justice if you ask me.
